Terms and Conditions of Use — Toveria
Version 2.0 — June 2026
These Terms and Conditions apply to all users of the Toveria platform.
Drafted in accordance with French law, European law and regulations applicable to international transactions.
Preamble
Toveria is a platform for connecting sellers and buyers of goods and services, operating in the B2C, C2C, C2B and B2B segments. Toveria acts as a marketplace intermediary within the meaning of Regulation (EU) 2022/2065 (DSA): it does not sell goods, does not own the items offered and does not store them physically.
Sellers are exclusively established in the European Union (27 Member States). Buyers may be located anywhere in the world, provided that the seller offers international delivery to their country.
Creating an account on Toveria implies full and unconditional acceptance of these Terms and Conditions.

Article 2 — Platform Access
2.1 Sellers — access conditions
Access to seller status on Toveria is reserved for persons:
- Established in the European Union (one of the 27 Member States) — the country entered in the profile is conclusive
- At least 18 years old (natural persons)
- Having a valid email address and a verifiable phone number
- Acting in a personal capacity (personal account) or on behalf of a registered business (professional account)
Selling is reserved for sellers established in the European Union. A user whose country is not located in the EU cannot create a listing, whether through manual publication or file import (CSV). If a seller relocates their address outside the EU, their already-published listings are automatically hidden from the entire platform (search results, homepage, recommendations, similar listings, profile) without being deleted, and are restored as soon as they enter an address in the EU again. This restriction limits the regulatory scope of the platform (anti-money laundering, DAC7 reporting obligations, consumer law) to the European Union area. As long as the country entered in the profile is not located in the EU, seller-specific features are disabled: payment account activation and configuration (Stripe account) are locked, and seller settings — carrier configuration and Kbis filing — are not accessible. These functions become available again once an EU address is restored.
2.2 Buyers — access conditions
Access to buyer status is open to natural and legal persons worldwide, subject to:
- Being at least 18 years old (or the legal age of majority in their country if higher)
- Having a valid email address
- Residing in a country to which the seller agrees to deliver
- Not appearing on applicable international sanctions lists (OFAC, EU, UN)
2.3 Account creation and uniqueness
Each user may hold only one Toveria account. Creating multiple accounts is prohibited. The user undertakes to provide information that is accurate, complete and up to date.
2.4 Account security
The user is responsible for the confidentiality of their login credentials. Any action performed from an account is presumed to be performed by its holder, except in the event of immediate notification of a breach to support@toveria.com.
2.5 Geographic restrictions
Registration and delivery are not available to certain countries, due to applicable international sanctions (in particular OFAC, European Union, UN) and the platform's compliance obligations (AML-CFT, export controls). The countries concerned do not appear in the selection lists during registration or profile update, and no order can be shipped there. This list may change depending on regulatory developments. As of the date of this version, the following are affected: Afghanistan, Belarus, North Korea, Cuba, Haiti, Iran, Libya, Mali, Myanmar, Nicaragua, Central African Republic, Russia, Somalia, Sudan, South Sudan, Syria, Venezuela, Yemen and Zimbabwe.
Article 3 — Account Types and Transaction Types
3.1 Personal Account (C2C / C2B)
Intended for persons acting in a non-professional capacity. Provides access to:
- Selling items without limit on number
- Purchasing items on the platform
- CSV file import
- All standard features
The personal seller certifies that they do not engage in habitual commercial activity and undertakes to comply with DAC7 thresholds.
3.2 Professional Account (B2C / B2B / B2X)
Intended for legal entities and merchants. Its opening requires:
- Valid SIRET number (or equivalent European)
- Kbis extract less than 3 months old (or equivalent European)
- Intra-Community VAT number (if subject to VAT)
- Country of goods storage
- DAC7 compliance certification
Professional accounts may sell to both consumers (B2C) and other professionals (B2B). In the case of B2B transactions — where the buyer is themselves registered as a professional account on Toveria — the protective provisions of consumer law, and in particular the right of withdrawal, do not apply as of right; return conditions are governed by agreement between the parties (see Article 8.2).
3.3 B2B Transactions — specific regime
When a professional buyer purchases from a professional seller:
- Consumer law protections do not apply (unless otherwise stated by the seller)
- VAT is applied according to applicable intra-Community or international VAT rules
- Legal B2B payment terms (maximum 60 days in France) apply to deferred payments
- A compliant invoice (with VAT if applicable) is generated automatically
Article 4 — Listings
4.1 Listing content
The user undertakes that their listings are accurate, sincere, complete and legal. The description must faithfully indicate the actual condition of the item (New with tag, New without tag, Very good condition, Good condition, Fair condition).
4.2 Prohibited items
The following are strictly prohibited on Toveria (non-exhaustive list):
- Counterfeit articles or unauthorized copies of protected brands
- Weapons, ammunition and armament accessories
- Drugs, narcotics and illicit psychoactive substances
- Prescription medications and regulated pharmaceutical products
- Protected animal and plant species (CITES Convention)
- Human organs and biological materials
- Personal data of third parties
- Pornographic content or content involving minors
- Cultural goods subject to export restrictions
- Any item subject to embargo or international sanctions (OFAC, EU, UN)
- Any item whose sale or export is prohibited by the laws of the seller's country or the destination country
4.3 Anti-counterfeiting certification
When publishing each listing, the seller explicitly certifies that the item is authentic and not counterfeit. This certification has contractual value and engages the seller's liability.
4.4 Price and currencies
The price is displayed in euros (EUR). Toveria service fees and shipping fees are displayed separately at checkout. For buyers outside the eurozone, the exchange rate and any bank fees are the buyer's responsibility and depend on their financial institution.
4.5 International shipping — customs obligations
When a seller ships outside the European Union, they undertake to:
- Correctly complete customs declarations (CN22 / CN23 forms depending on value)
- State the actual market value (any fraudulent undervaluation is illegal)
- Refrain from shipping items subject to import restrictions in the destination country
- Inform the buyer of any applicable taxes and customs duties in their country (at the buyer's expense)
Customs duties, import taxes and local administrative fees are always the buyer's responsibility unless explicitly stated otherwise in the listing.
Article 5 — Transactions
5.1 Purchase process
- The buyer selects an item and proceeds to payment (or makes an offer)
- Payment is secure and processed by Stripe (escrow until delivery confirmation)
- The seller is notified and proceeds to shipment within the stated timeframe
- The buyer confirms receipt — funds are released to the seller
- In the absence of confirmation within 21 days (personal) or 21 + withdrawal days (professional), funds are released automatically
5.2 Seller obligations
The seller undertakes to:
- Ship the item within a reasonable timeframe after payment confirmation (recommended: 3 business days)
- Package the item carefully
- Communicate the tracking number to the buyer
- Handle export customs formalities if applicable
5.3 Buyer obligations
The buyer undertakes to:
- Pay the total amount indicated when validating the order
- Handle import formalities and pay customs duties in their country
- Confirm receipt of the item within the stated timeframes
5.4 Buyer protection — escrow
Funds are held by Toveria until confirmation of proper receipt. This protection covers buyers worldwide, without geographic distinction.
Article 6 — Fees and Pricing
6.1 Service fees (buyer commission)
Service fees are the responsibility of the buyer according to the following tiered schedule:

Service fees do not apply to free donations.
6.2 Seller commission
The seller receives 100% of the listed price for their listing. Toveria does not charge any commission on the amount received by the seller.
6.3 Pro Subscriptions

Subscriptions are reserved for professional accounts. Personal accounts have access to all standard features without subscription.
6.4 Boost and promotion
- 7-day Boost: €1.99

Boost fees are non-refundable once activated, including in the event of listing deletion, account suspension or voluntary closure.
6.5 Shipping fees
Shipping fees are displayed separately and vary depending on the carrier, weight, dimensions and destination. They are the buyer's responsibility unless the seller has activated the "Free shipping" option.
Article 7 — Payments and Financial Security
7.1 Payment processing
All payments are processed by Stripe (PCI DSS Level 1 certified). Toveria does not collect or store users' banking data.
7.2 Currencies and conversion
Transactions are denominated in euros. Stripe handles currency conversions for buyers wishing to pay in their local currency. Any exchange fees are the buyer's responsibility.
7.3 Transfers to sellers
Transfer is made after transaction completion. The timeframe depends on the seller's Stripe Connect account (generally 2 to 5 business days after funds are released).
7.4 VAT and international transactions
- B2C (EU seller → non-EU buyer): export without VAT, local taxes in the buyer's country may apply on import
- Intra-Community B2B: VAT reverse charge between taxable persons (art. 283-2 CGI)
- Intra-Community B2C: VAT of destination country via OSS window
- B2C (non-EU buyer, value < €150): VAT applicable via IOSS regime
7.5 Financial disputes
In the event of a payment dispute, the buyer must contact Toveria at support@toveria.com before initiating any bank chargeback procedure. Toveria acts as mediator and may retain funds during resolution.
7.6 Fund escrow
The price paid by the buyer (item + shipping + commission) is placed in escrow via Stripe Connect. Funds owed to the seller are released only after delivery, either upon confirmation of receipt by the buyer or automatically upon expiration of the stated timeframe without dispute. In the event of a dispute, funds remain in escrow until resolution.
7.7 Seller identity verification (KYC)
Before any transfer, the seller must complete the identity verification required by Stripe Connect. Professional sellers must also provide a valid Kbis extract. Until this verification is complete, transfers are suspended, without prejudice to order completion by the buyer.
7.8 Tax reporting obligations (DAC7)
In accordance with Directive (EU) 2021/514 ("DAC7") and Articles 1649 ter A to 1649 ter E of the French Tax Code, Toveria is required to collect, verify and report to the tax authority certain information relating to sellers (including their tax identification number — TIN) once they reach, during a calendar year, 30 sales or €2,000 in revenue on the platform.
The seller concerned undertakes to provide a valid TIN. Failing this, or in the event of an invalid TIN, transfers are suspended until regularization. Tax information is retained for 10 years in accordance with legal obligations, then purged. The report is transmitted to the tax authority before January 31 of the following year.
7.9 Transfer blocking and retention
Toveria may block or retain a transfer in the following cases: incomplete KYC verification, missing or invalid TIN (DAC7), ongoing dispute, account suspension, or reasoned suspicion of fraud. Blocking does not affect amounts owed, which are released once regularization is complete.
Article 8 — Right of Withdrawal
8.1 Consumer buyer from a professional seller (B2C)
In accordance with Article L.221-18 of the French Consumer Code, the consumer buyer has a period of at least 14 days, freely extended by the seller in their settings, from receipt to withdraw. Reimbursement is full.
This right applies regardless of the buyer's country of residence, provided that the seller is established in the EU and that the order results from a distance solicitation.
8.2 Professional buyer from a professional seller (B2B)
The right of withdrawal is a consumer protection: it does not apply as of right to transactions between professionals (B2B) concluded at a distance on Toveria. Return conditions and reimbursement are governed by agreement between the parties, who may provide for them contractually.
Clarification (French law): Article L.221-3 of the French Consumer Code extends certain consumer protections — including the right of withdrawal — to the professional buyer employing no more than five employees and contracting outside the scope of their main activity, but only for contracts concluded outside the business premises. Since sales made on Toveria are distance contracts, this extension does not apply.
8.3 C2C and C2B transactions
Transactions between individuals or from an individual to a professional do not benefit from the legal right of withdrawal. The buyer may, however, request Toveria mediation.
8.4 Exceptions
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized items or to unsealed items that cannot be returned for hygiene reasons.
8.5 Withdrawal outside the EU
Buyers residing outside the European Union do not automatically benefit from the European right of withdrawal. They are subject to the legislation of their country, unless the seller voluntarily extends this protection in their settings.
Article 9 — International and Customs Compliance
9.1 Seller responsibility on export
The seller is responsible for complying with their country's export regulations and the destination country's customs restrictions. Toveria cannot be held responsible for a customs blockage resulting from a seller's error.
9.2 Buyer responsibility on import
The buyer is responsible for complying with their country's import regulations, paying customs duties and local taxes, and obtaining any necessary import authorizations.
9.3 Sanctions and embargoes
Toveria complies with international sanctions regimes (EU, UN, OFAC). Before each payment, the parties are subject to automatic screening against sanctions lists, using the independent service OpenSanctions (which aggregates in particular OFAC, UN and EU lists). Any match with a sanctioned person or entity — or any transaction involving a country under embargo — results in automatic blocking of the operation. Alerts are logged and processed as part of the anti-money laundering and counter-terrorism financing (AML-CFT) system.
Article 10 — Listings, Conduct and Intellectual Property

10.1 Multilingual content
Listings may be written in any European language. Toveria reserves the right to require a French or English version for listings intended for an international audience.
10.2 Rights to published content
By publishing content on Toveria, the user grants Toveria a worldwide, non-exclusive and free license to display, reproduce and promote this content in connection with the operation of the platform, including for purposes of translation and adaptation for international markets.
Article 11 — User Conduct
11.1 General obligations
Each user undertakes to respect other members, not to use insulting, discriminatory or hateful language, not to harass or threaten, not to usurp the identity of others, and not to use the platform for unlawful purposes.
11.2 Off-platform transactions
It is prohibited to conclude transactions outside Toveria to circumvent service fees. Any agreement intended to circumvent the Toveria payment system is contrary to these Terms and Conditions.
Article 12 — Reviews and Ratings
Reviews may only be published by users who have completed a finalized transaction. Reviews must be honest and objective. False reviews are prohibited in accordance with the DDADUE law of March 3, 2023.
Article 13 — Reports, Moderation and Suspension
13.1 Reports
Toveria processes reports within 72 hours (24 hours for manifestly unlawful content), in accordance with Regulation (EU) 2022/2065 (DSA). Any user may report a listing or conduct via the provided tools.
13.2 Automatic moderation of listings
Upon publication and modification, the title and description of listings are subject to automatic review. A listing may be:
- rejected when it contains a term referring to a prohibited product or content;
- placed on hold for verification (not publicly visible) when it contains a term to be verified or personal contact details (phone, email) intended to circumvent platform messaging and payment.
These controls supplement — without replacing — reports and human moderation.
13.3 Sanctions and account suspension
In the event of breach of these Terms and Conditions (prohibited listing, fraud, circumvention, unlawful content, non-payment, abuse), Toveria may, depending on severity: issue a warning, remove a listing, temporarily suspend or permanently terminate the account. Suspension may result in blocking of pending transfers (see art. 7.9) pending verification.
The user is informed of the measure and may contest it by writing to support@toveria.com; Toveria will reconsider the decision within a reasonable timeframe.
Article 14 — Toveria's Liability
Toveria acts as a technical intermediary and is not a party to transactions. Toveria does not guarantee the quality, compliance or legality of items offered for sale, nor their suitability for import into the buyer's country.
Toveria's liability is limited to the amount of service fees collected on the transaction in question.
Article 15 — Personal Data
The processing of personal data is governed by Toveria's Privacy Policy, accessible on the platform.
Article 16 — Mediation and Dispute Resolution

16.2 B2B disputes
Disputes between professionals are subject to the competent jurisdiction defined in Article 18.
16.3 International disputes
For disputes involving buyers outside the EU, the parties undertake to attempt amicable resolution via Toveria before any legal proceedings. In the absence of agreement, French law and French jurisdiction are exclusively competent.
Article 17 — Pro Subscriptions
Pro subscriptions (Starter €5/month, Business €15/month) are reserved for professional accounts. Managed via Stripe Billing. Upon termination, access is maintained until the end of the billed period.
Article 18 — Applicable Law and Jurisdiction
These Terms and Conditions are governed by French law. Any dispute not resolved amicably shall be submitted to the French courts within the jurisdiction of Toveria's registered office.
For consumers residing in another EU Member State, the mandatory consumer protection provisions of their country of residence also apply.
Article 19 — Language of Contract
These Terms and Conditions of Use, as well as all of Toveria's contractual and informational documents (in particular the Privacy Policy, GDPR Policy, Pricing Terms and Legal Notices), are drafted in French, which constitutes the reference language.
Toveria may make translations of these documents available in other languages. These translations are provided for informational purposes only and for the sole convenience of the user and have no independent contractual value.
In the event of divergence, contradiction or difficulty of interpretation between the French version and a translated version, only the French version is binding and prevails between the parties.
This clause applies without prejudice to mandatory consumer protection provisions in force in the user's country of habitual residence, which remain applicable when required by law.
Article 20 — Modification of Terms and Conditions
Substantial modifications are notified with 30 days' notice. Continued use of the platform after this period constitutes acceptance.
