5. Nature of Activity
Toveria is a marketplace platform connecting sellers and buyers of goods and services. Toveria acts as a market intermediary within the meaning of Regulation (EU) 2022/2065 (DSA).
Toveria does not purchase, does not sell and does not store merchandise. It cannot be considered a party to transactions carried out between its members.

6. Intellectual Property
6.1 Toveria Content
The Toveria website, its structure, design, logos, graphic charter, texts, functionalities and source code are the exclusive property of Toveria and are protected by French and European intellectual property law.
Any reproduction, representation, modification, publication or adaptation of all or part of the website elements, by any means or process whatsoever, is prohibited without the prior written consent of Toveria.
6.2 Content Published by Users
By publishing content on Toveria (photos, descriptions, videos), the user grants Toveria a worldwide, non-exclusive, royalty-free and transferable licence to display, reproduce, adapt and promote this content in connection with the operation of the platform, including for marketing and institutional communication purposes.
The user warrants that they hold the rights to the published content and that it does not infringe the rights of third parties.
6.3 Trademarks
"Toveria" is a trademark pending registration with the National Institute of Industrial Property (INPI). Any unauthorised use of this trademark is prohibited.
7. Liability
7.1 Technical Intermediary
In accordance with Article 6 of the LCEN and Article 6 of the DSA Regulation, Toveria acts as a host of content published by its users. As such, Toveria is not responsible for the content of listings, messages and reviews published by users, provided that it promptly removes any manifestly unlawful content that is reported to it.
7.2 Accuracy of Information
Toveria endeavours to keep the information published on the platform up to date and accurate, but cannot guarantee the completeness or absence of errors in technical, pricing or legal information.
7.3 Availability
Toveria undertakes to implement the necessary means to ensure the availability of the platform, without however guaranteeing continuous and uninterrupted availability. Scheduled maintenance may be performed.
7.4 Hyperlinks
The platform may contain links to third-party websites. Toveria exercises no control over these sites and disclaims any responsibility for their content.
8. Moderation and Reports (DSA)
8.1 Reporting Mechanism
In accordance with Article 16 of Regulation (EU) 2022/2065 (DSA), any user may report unlawful or non-compliant content via:

8.3 Transparency Report

9. Consumer Dispute Mediation
9.1 BtoC Mediation
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, Toveria offers a consumer mediation scheme.

9.3 BtoB Disputes
Disputes between professionals are governed by French law and the jurisdiction of the court having competence in the district of Toveria's registered office, unless otherwise agreed between the parties.
10. Applicable Law and Jurisdiction
These legal notices and all legal relationships between Toveria and its users are governed by French law.
Any dispute relating to the use of the Toveria platform shall be submitted, failing amicable resolution, to the exclusive jurisdiction of the courts of the district of Toveria's registered office.
For consumers residing in another Member State of the European Union, the mandatory consumer protection provisions of their State of residence shall also apply.

12. Tax Compliance — DAC7
In application of Directive (EU) 2021/514 (DAC7), Toveria is required to collect and declare annually to the Directorate General of Public Finances (DGFiP) information relating to sellers exceeding the following thresholds:
- 30 transactions in the calendar year, or
- €2,000 in gross revenue in the calendar year
Sellers concerned are informed before any transmission to the tax authorities.
